Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and SK7 Ltd (“we”, “us”, “our”) governing your use of the Habit Pact mobile application (“Pact”, the “App”). By downloading, accessing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use the App. By using the App you represent that you meet this requirement and that the information you provide is accurate.
2. Your account
- You create an account using an email address and password, or by signing in with Google.
- You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.
- Notify us promptly at support@pactwithfriends.com if you suspect unauthorised use of your account.
3. The service
Habit Pact lets you create and track habits, view your progress, add friends, share habits with them, and exchange messages within a shared habit. We may add, change, or remove features at any time. We may also offer the App and its features free of charge and are not obligated to continue doing so.
4. Your content
- You retain ownership of the content you create in the App, such as habit names and chat messages (“Your Content”).
- You grant us a limited, worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display Your Content solely to operate and provide the App to you and to the friends you choose to share with.
- You are responsible for Your Content and confirm you have the right to share it.
5. Acceptable use
When using the App — especially in shared habits and chat with other users — you agree not to:
- post or transmit content that is unlawful, harassing, hateful, threatening, defamatory, or obscene;
- impersonate any person or misrepresent your affiliation with anyone;
- upload malware or attempt to disrupt, damage, or gain unauthorised access to the App or its systems;
- use the App to spam or send unsolicited messages to other users;
- collect or harvest other users' data; or
- use the App in violation of any applicable law or regulation.
We may remove content or suspend or terminate accounts that violate these Terms.
6. Interactions with other users
Social features let you connect and share with other people. You are solely responsible for your interactions with other users. We are not responsible for the conduct or content of any user, and we do not screen or moderate all content. Only share habits and information with people you trust.
7. Not medical or professional advice
Habit Pact is a general self-improvement and habit-tracking tool. It does not provide medical, health, psychological, financial, or other professional advice, and it is not a substitute for advice from a qualified professional. Do not rely on the App for any decision that requires professional judgement. If you have concerns about your health, consult a qualified healthcare provider.
8. Third-party services
The App relies on third-party services, including Google Firebase (authentication, cloud database, push notifications, and analytics), Google Sign-In, and the Apple App Store and Google Play. Your use of those services is subject to their own terms and privacy policies. We are not responsible for third-party services.
9. Intellectual property
The App itself — including its software, design, branding, logos, and the “Pact” and “Habit Pact” names — is owned by us or our licensors and is protected by intellectual property laws. Except for the limited right to use the App under these Terms, we grant you no rights in the App. You may not copy, modify, reverse-engineer, distribute, or create derivative works of the App except as permitted by law.
10. Disclaimers
The App is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or that data will always be preserved or synced. You are responsible for maintaining your own records if needed.
11. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the App. To the extent liability cannot be excluded, our total liability to you for any claim relating to the App is limited to the greater of the amount you have paid us in the 12 months before the claim, or EUR 50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits any rights you have as a consumer that cannot be limited by law.
12. Termination
You may stop using the App and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the App. Sections that by their nature should survive termination (including ownership, disclaimers, and limitation of liability) will survive.
13. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and, where appropriate, notify you in the App. Your continued use of the App after changes take effect means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of Slovenia, without regard to its conflict-of-laws rules. The courts of Slovenia will have jurisdiction over any dispute, unless mandatory local law gives you the right to bring proceedings elsewhere.
